61岁大妈泡温泉在池边跳钢管舞摔倒身亡 ，家属索赔89万，法院咋判的？
这个案件经过了两次判决，一审法院判决，酒店负有30%责任，赔偿死者家属共计30余万元。酒店对一审判决不服，提请了上诉；二审法院撤销了一审判决，重新判定酒店无责任。虽然酒店没有责任，但还是对死者家属，进行了人道主义赔偿，赔偿金额合计148284元。
通过案件宣判，以及酒店善后处理来看，是一个完美结案案件。法院做到了公平公正，不因为死者家属悲痛心情，就同情弱者判定酒店有责任。而酒店被判无责情况下，还能够进行人道主义赔偿，说明这是一家有大爱企业。
事件梳理：大妈泡温泉跳钢管舞摔忘，家属向酒店索赔89万事情发生在云南一位大妈身上，她在退休之后，开始了愉悦的养老时光。虽然年过六旬，却依然青春时尚，学着年轻人一样，拍摄短视频发布到网络平台上。
同姐妹们一起享受退休生活，泡着惬意的温泉，这样美妙时光，怎么能少了短视频记录。在姐妹们提议下，爱美的大妈利用舞池旁钢管，跳起了舞蹈。
看到大妈柔软的身姿，加上漂亮动作，姐妹们称赞不已。在姐妹们欢呼、尖叫声中，大妈表演也越来越卖力，危险性大幅增加。
大妈忽略了泳池危险，也忘记了自己已经不再年轻。大妈没能控制好平衡，让自己在泳池边摔倒，当时就昏了过去。尽管姐妹们及时呼叫救护车，加上酒店应急处理，也没能挽回大妈的生命。
在大妈不幸离开后，其家人将酒店告上法庭。表示酒店没有尽到安全保障义务，加上提醒标识不够醒目，让其承担家人去世责任，赔偿89万余元。
法院经过两次审理判决，做到不偏不倚、公平公正面对家属的诉讼，酒店非常生气，表示自己不应该承担责任。温泉酒店经营过程中，不仅张贴了明显提示，还对浴池边做了防滑处理。大妈的摔倒，完全是自身不注意安全，出现了危险行为，到头来酒店却要为其行为买单。
法院通过了解事情，认定酒店未采取有效防滑措施，做出了一审判决，认定酒店承担30%责任，所有赔偿费用加在一起，合计30万元。
这样一份判决，酒店不能够接受，便提请了上诉。二审法院再次梳理事件，认定酒店经营管理过程中，尽到了提醒和防护义务；且大妈摔倒后，酒店也及时送医救治。基于上面这两点，二审法院决定撤销一审法院判决，重新判定酒店没有责任。
两次判决结果不同，彰显了层级更高法院，在处理案件时候，更偏向于法理，而不是人情。在倩倩个人看来，这份判决公平公正，且非常合理。
酒店处理引人赞，大爱企业受人迎酒店虽然没有责任，但还是对大妈家属，进行了人道主义赔偿。作为一家大型温泉酒店，他们虽然实力雄厚，不差30万元赔偿，但我想他们据理力争的是，自身是否有责任。
整件事情中，大妈作为成年人，明知行为具有危险性而为之，这就是再拿自己生命开玩笑。酒店既有安全措施，又尽到了提醒义务，本就不该承担责任。
法院判定酒店无责后，他们还是愿意，对遇难者家属进行人道主义赔偿，从这里便能够看出，酒店背后的企业，是一家有爱心企业。
